         Licensing

The freedom of parties to privately contract and have those contracts enforced by a government in a neutral arena is one of the most important concepts in a successful society.  While the law provides some limited default rules in the absence of an express contract, there are virtually an infinite number of ways two parties can define their legal relationship.

Intellectual property licensing requires a highly technical knowledge of the intellectual property laws and their interaction with other legal disciplines.  For example, it's not sufficient to only know the ins and outs of employment law when drafting an employment agreement between an employee and employer concerning the patent rights of the employer with respect to inventions made by the employee during the course of the employment.  In another example, a trusts and estates practitioner must understand the copyright code when drafting a will which disposes of a termination right to a copyright transfer as the code specifies which heirs inherit the right for a given set of circumstances.

I can assist you in crafting and negotiating the proper agreement to suit your particular needs.
